THESE TERMS OF SALE GOVERN YOUR SHOPPING EXPERIENCE, INCLUDING PURCHASES OF LOVE PRODUCTS, IN LOVE STORES (AS DEFINED BELOW) IN FRANCE, BUT ALSO IN MANY OTHER COUNTRIES. PLEASE READ THESE TERMS CAREFULLY BEFORE ORDERING PRODUCTS ONLINE OR OTHERWISE PURCHASING FROM LOVE STORES (AS DEFINED BELOW).
PLEASE NOTE THAT YOUR USE OF AND ACCESS TO LOVE STORES (AS DEFINED BELOW) ARE SUBJECT TO THE FOLLOWING TERMS; BY SHOPPING IN ANY LOVE STORE OR PURCHASING A LOVE PRODUCT ONLINE, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS OF SALE. IF YOU DO NOT ACCEPT THESE TERMS, YOU MUST (A) DISCONTINUE USING OR SHOPPING FROM OUR STORES, (B) NOT MAKE ANY PURCHASE, AND/OR (C) RETURN ANY ELIGIBLE PURCHASE WITHIN THE APPLICABLE RETURN WINDOW.
You are subject to these TERMS AND CONDITIONS AND MAY PURCHASE LOVE PRODUCTS if you are of legal age in your jurisdiction or have the consent of your parent or guardian.
APPLICABILITY
These Terms of Sale ("Terms of Sale" or "Terms") apply to your purchases, orders, purchases, and returns from the Love-official.com digital store (the "LOVE STORE CONCEPT").
Love-official.com is an authorized licensee of LOVE. ("LOVE") and the operator of the online digital stores. These Terms of Sale create a legal agreement between you and Love-official.Com and affiliated companies (which we may refer to as “Love Concept Store,” “we,” “us,” or “our”) whose registered office and principal place of business is located at Boulevard de Grand Case, 97150 Saint-Martin.

Love-official.com may revise these Terms of Sale at any time. The current Terms of Sale will be published on Love-official.com. The Terms of Sale published at the time you purchase products from the LOVE CONCEPT STORE will govern that purchase. In addition to the Terms of Sale, by making purchases and/or purchasing from the LOVE CONCEPT STORE, you acknowledge and agree to be bound by our Terms of Use and Privacy Policy, which are incorporated herein by this reference.
PRODUCT PURCHASES
NO PURCHASES FOR RESALE
The LOVE CONCEPT STORE is intended solely for the benefit of end consumers, and therefore the purchase of products for resale is strictly prohibited. Purchases for resale refer to the purchase of a product by someone who intends to resell the product to others (consumers, businesses, or any third party). If we determine that a purchase or order is intended for resale, we reserve the right, in our sole discretion, with respect to that purchase or order, to (1) suspend enforcement of any policy that grants a right or benefit intended for direct consumer purchases; and (2) take any action intended to prevent such a purchase or order (and discourage future purchases or orders), including, without limitation, restricting sales to any consumer, consumer account, or member account, canceling orders, charging restocking fees, imposing purchase quantity limits, refusing to issue refunds or accept returns, and/or suspending or terminating any account.
HOW TO SHOP – DIGITAL STORES
To complete your purchase at the LOVE CONCEPT STORE, you must provide your full name, email address, a valid shipping address, and a payment method to place an order online. You may need to adjust your device settings or configure your browser to accept functional cookies and pop-ups in order to use all the features of LOVE CONCEPT STORE, including adding items to your basket and submitting your order. When you submit an order, we will send you an email acknowledging receipt of your order (“Order Confirmation”). Our acceptance of your order occurs when the products are dispatched to you; we will send a second email confirming that the products have been dispatched. If we are unable to If we fail to provide you with a product, we will notify you in writing and will not process your order for that product.
OUR RIGHT TO REFUSE YOUR PURCHASE OR CANCEL AN ORDER
The sale of products and the fulfillment of all orders at LOVE CONCEPT STORE are subject to availability and our discretion in managing inventory. We expressly reserve the right to limit, refuse, or reject any sale or order for any reason, without being liable for any damages or costs other than the refund of any amounts received from you in connection with such sale or order, in situations including, but not limited to:
an Event Beyond Our Control (as defined below);
the product you wish to purchase is not available or in stock;
your address, billing information, or payment method is incorrect or cannot be verified; Your order is flagged by our security systems as potentially fraudulent or as an order placed using automated ordering software or technology;
There is evidence that your order (single or cumulative orders) was purchased for resale, tax evasion, or any other fraudulent purpose;
Your order has been flagged for freight shipment or shipment to an address or service provider that permits or enables foreign export or illegal sales tax avoidance;
Your purchase or order exceeds the product purchase limits (quantity and/or dollar amount);
Your account and/or purchase history has a high volume of returns;
There is evidence that you are not authorized to make purchases; or
There is a spelling, pricing, or other error or mistake at LOVE CONCEPT STORE.
We will determine whether any of the above events have occurred at our sole discretion.

TRANSFER OF TITLE and RISK OF LOSS 

Title and risk of loss for products purchased from LOVE CONCEPT STORE pass to you upon our delivery to the carrier. Title to the product(s) will not pass until full payment has been received.
INDEMNIFICATION AND RELEASE
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless LOVE CONCEPT STORE, as well as each of their affiliates, officers, directors, employees, agents, licensors, and suppliers (the "Indemnified Parties") from and against all claims, losses, liabilities, expenses, damages, and costs, including, without limitation, attorneys' fees, arising from or related to your conduct in connection with LOVE CONCEPT STORE or with other users or consumers, or any violation of these Terms of Sale, any law, or the rights of a third party. You, for yourself and on behalf of your heirs, estates, insurers, successors, and assigns, hereby fully and forever release and discharge the Indemnified Parties from any and all claims or causes of action you may have for damages arising from or related to your conduct in connection with LOVE CONCEPT STORE or with other users or consumers, or any violation of these Terms of Sale, any law, or the rights of any third party.
LIMITATION OF LIABILITY
These terms and conditions define the entire scope of our AGREEMENT AND INCLUDE ANY CLAIMS ARISING FROM OR RELATED TO YOUR PURCHASES, ORDERS, RETURNS, ACCESS, OR USE OF THE LOVE CONCEPT STORE STORES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, the maximum aggregate liability of either party to the other for all claims ARISING OUT OF OR RELATED TO THIS Agreement, whether in contract, warranty, tort, strict liability, statute or otherwise, SHALL BE LIMITED TO THE AMOUNT PAID TO LOVE CONCEPT STORE FOR THE PRODUCT(S) PURCHASED IN THE RELEVANT TRANSACTION.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NONE OF THE INDEMNIFIED PARTIES SHALL BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, FOR: ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE LOVE STORES; OR FOR THE PERFORMANCE OF PRODUCTS PURCHASED FROM THE LOVE STORES; OR FOR THE CONDUCT OF USERS OR CONSUMERS OF THE LOVE STORE (WHETHER ONLINE OR OFFLINE); OR FOR ANY USER CONTENT OR ANY OTHER ACTIVITY IN CONNECTION WITH YOUR PURCHASES, ORDERS, PURCHASES, OR USE OF THE LOVE CONCEPT STORE, EVEN IF AN INDEMNIFIED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF AND ACCESS TO THE LOVE STORE. YOUR SOLE REMEDY AGAINST THE INDEMNIFIED PARTIES IN CONNECTION WITH ANY ALLEGED DAMAGES ARISING FROM YOUR USE OF OR ACCESS TO THE LOVE STRENGTH STORE OR ANY CONTENT IS TO DISCONTINUE USING OR ACCESSING THE LOVE STORE. IF ANY PART OF THIS LIMITATION OF LIABILITY IS DETERMINED TO BE UNENFORCEABLE OR INVALID FOR ANY REASON, YOU AGREE THAT THE LIABILITY OF ANY INDEMNIFIED PARTY TO YOU FOR ANY DAMAGES OR LOSSES WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
DISCLAIMER OF WARRANTY
WE PROVIDE ACCESS TO THE LOVE STORES ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH REPRESENTATIONS AND WARRANTIES ARE HEREBY EXPRESSLY DISCLAIMED. WITHOUT LIMITING THE FOREGOING, (1) LOVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, FOR ANY PRODUCT. LOVE FURTHER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, AS TO THE ACCURACY OR COMPLETENESS OF EACH PRODUCT, INCLUDING, WITHOUT LIMITATION, PRICE, QUANTITY, AND SIZING; (2) LOVE DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION PUBLISHED IN THE STORES LOVE ARE ACCURATE, COMPLETE, OR CURRENT, OR THAT THEY WILL OPERATE UNINTERRUPTED, ERROR-FREE, OR FREE OF DEFECTS, BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS; AND (3) THE ABOVE DISCLAIMER OF WARRANTIES SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
DISPUTES
CHOICE OF LAW, JURISDICTION, CLAIMS TIME LIMIT
You agree that these Terms and any dispute between you and any Indemnified Party shall be governed in all respects by EU law, without regard to its choice of law provisions, and not by the 1980 United Nations Convention on Contracts for the International Sale of Goods. Except where prohibited by applicable law, and without limiting any statutory consumer rights, you agree that all disputes, claims, and legal proceedings arising directly or indirectly out of or related to LOVE CONCEPT STORE (including, but not limited to, the purchase of LOVE products) shall be resolved individually, without resort to any form of class action.
You agree to waive all defenses of "lack of personal jurisdiction" and "inconvenient forum."
All claims must be filed within 6 months after the claim arises, except to the extent a longer period is required by applicable law.
RIGHT OF ASSIGNMENT, NO WAIVER, SEVERABILITY
We may assign our rights and duties under these Terms to any party at any time without notice to you, unless notice is required by applicable law, but this will not affect your rights or our obligations under these Terms. You may only transfer your rights or obligations under these Terms to another person if we agree to this in writing. Our failure to insist on or enforce strict performance of these Terms does not constitute a waiver of any of these Terms or our rights. If we waive a default by you, we will only do so in writing, and that does not mean that we will automatically waive any subsequent default by you. You should always assume that these Terms apply.
If a court or competent authority decides that any provision of these Terms is invalid or unenforceable, the remainder of these Terms will continue to apply.
PRICE/PAYMENT
PAYMENT
Payment is captured at the time of sale in-store. We accept several payment methods at checkout. The redemption/use of gift cards to purchase products is subject to separate terms and conditions. Please do not attempt to pay using a payment method not accepted at checkout. If you do so, we will not be liable for any loss of payment or other damages that may result from this action. PRICES AND CURRENCY
Product prices displayed on products, packaging, signage, or otherwise displayed in the LOVE CONCEPT STORE include VAT. Shipping rates are applied per order. Prices are quoted and payable exclusively in euros. Product prices will be as displayed in the LOVE CONCEPT STORE. Prices may change from time to time, but changes will not affect any order confirmed by us in an Order Confirmation.
YOUR TOTAL PRICE
The total price specified in the final payment screen on the LOVE CONCEPT STORE includes taxes and shipping charges (if applicable). If you pay by credit or debit card, the total amount of your entire purchase will be reflected on your statement in your local currency. If your local currency is not euros, your Your bank or credit card issuer will apply the exchange rate and all fees in accordance with the terms and regulations applicable to you and your bank/credit or debit card issuer. The exchange rate and fees applied by the bank/issuer are beyond our control.
SHIPPING AND DELIVERY
DELIVERY – WHERE AND WHEN
We do not deliver on certain holidays. We can only fulfill an order to a valid delivery address that is a home or business address. Delivery options and fees in the LOVE CONCEPT STORE may change over time, but shipping fees will not change for a particular order once confirmed at checkout.
SPLIT DELIVERY
Multi-unit orders may be delivered in multiple shipments. We reserve the right to split delivery of any order. If we split your order, we will notify you of our intention to do so by sending an email to the email address you provided when your order was placed. You will not be charged any additional delivery fees.
INSPECTION UPON DELIVERY
Upon delivery, please inspect the packaging and products for any damage. If the products appear damaged, please do not accept the shipment and contact the LOVE CONCEPT STORE customer service team for assistance.
RETURNS AND CANCELLATIONS
CANCELLING ORDERS BEFORE SHIPMENT

If you wish to cancel your order, please contact our customer service as soon as possible. Order cancellations may be subject to a cancellation fee if the order has already been processed or shipped.
RETURNING PRODUCTS AFTER PURCHASE/DELIVERY
Returns must be requested within 30 days and all products must be returned in new and unused condition. Equipment must be unused with its original packaging, and clothing must be unworn with its tags still attached.
RETURNING DEFECTIVE PRODUCTS
You have the right to return products if they are defective or do not conform to your order when you receive them. This does not affect your statutory rights. If your claim is justified (as determined by LOVE CONCEPT STORE in its sole discretion), the purchase price and any shipping costs will be refunded. For information on how to return defective products, please visit the Returns section of the LOVE CONCEPT STORE. REFUND INFORMATION
Refunds will be issued to the original payment method. Except for returns of defective products approved by LOVE CONCEPT STORE in its sole discretion, you will be responsible for paying all shipping charges charged at the time of payment AND all shipping charges to return any product. The shipping charges to return your product(s) will be deducted from the purchase price of your returned product(s), and the net amount will be refunded once the return is received and accepted.
Return shipping charges may be higher or lower than the original purchase price, depending on the shipping rates in effect at the time of return. Return shipping charges will be notified to you when a return is initiated.

Shipping the product to a location other than that indicated on the return label may result in the rejection of all customer claims regarding the return. Returns received without a valid RMA number and a shipping label provided by LOVE CONCEPT STORE are subject to rejection and return to the customer at the customer's expense. We reserve the right to refuse a refund for any unauthorized return.

An Event Outside Our Control means any act or event beyond our reasonable control, including, without limitation, supply chain shortages, strikes, lockouts, or other industrial action by third parties, civil unrest, riots, invasions, terrorist attacks or threats of terrorist attacks, war (declared or undeclared) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, or failure of public or private telecommunications networks.
If an Event Outside Our Control occurs that affects the performance of our obligations under these Terms: (1) we will notify you as soon as reasonably practicable; and (2) our obligations under these Terms will be suspended, and the time for performance of our obligations will be extended, for the time necessary to resolve the Event Outside Our Control. If an Event Outside Our Control affects the delivery of a Product, we will arrange a new delivery date with you once the Event Outside Our Control has passed. You may cancel your order if an Event Outside Our Control occurs and you no longer wish us to supply the Products.
